What’s not covered
The fair-warning list.
No small print, no surprises. Here’s exactly what this policy doesn’t cover.
- Costs run up before the insurer accepts the claim, or without the insurer’s consent
- Disputes that existed or that you knew (or should have known) about before cover started
- Deliberate or reckless acts, claims alleging dishonesty, and defamation (libel or slander)
- Defending a professional-duty claim or a claim against you as a director or officer, and property damage or injury defence
- Disputes with government or local authorities over statutory charges; judicial reviews and challenges to legislation
- Shareholder and partnership disputes, and disputes with a subsidiary, parent or associated company
- Fines, penalties and court-ordered criminal costs (limited exceptions under the Employment Defence and Data Protection sections)
- Intellectual property — patents, copyright, trade marks, confidential information (except under Employment Pursuit); franchise and agency-rights disputes
- Disputes with the insurer itself
- Conditions you have to meet
- A claim must have reasonable prospects of success — more likely than not to succeed — assessed on the merits of each individual claim; you must report it as soon as possible and within the period of insurance; and you must act as if uninsured to keep costs down.
- Excess and co-insurance
- An excess applies as shown in your schedule. A 40% co-insurance applies if you choose your own representative and they won’t accept the insurer’s standard charging rates.
- Where you’re covered
- The UK, Isle of Man and Channel Islands; the circumstances must arise during the period of insurance and within the territorial limits.
This is a summary. Your policy wording (BTE Commercial LEI) sets out the full list of exclusions and conditions — please read it.
