What’s not covered
The fair-warning list.
No small print, no surprises. Here’s exactly what this policy doesn’t cover.
- Claims with no reasonable prospects of success (a 51% or better chance), assessed throughout the claim
- Costs we have not agreed in advance or before we accept the claim in writing
- Parking or obstruction offences
- Claims where a reasonable estimate of the legal costs is more than the amount in dispute (except uninsured loss recovery)
- Claims arising from a deliberate or criminal act or omission, fines or penalties from a criminal court, or proceedings alleging dishonesty or intentional violence
- Incidents where you were under the influence of alcohol or drugs
- Incidents where you had no valid driving licence, no valid MOT (where required), or the vehicle was not roadworthy — and, for Motor Prosecution Defence, where your licence had more than 9 points at the time
- Use of the vehicle for racing, rallies, competitions or trials
- Claims not reported within 180 days of the event
- Incidents outside the geographical limits (except enforcing a UK judgment abroad, with our prior approval)
- Judicial reviews and challenges to legislation; VAT you can recover elsewhere
- Travel expenses or compensation for time off work; costs if you withdraw from proceedings without our agreement; costs covered by a more specific insurance or already refused by another insurer; and fixed recoverable costs already recovered by the solicitor
- Standard general exclusions: war and terrorism, nuclear and radioactive contamination, electronic data and computer-virus loss, and anything that would breach sanctions
- Hire Vehicle (Elite Extra only)
- Provided only after an accident with an identifiable third party that leaves the insured vehicle undriveable or stolen, for up to 14 days and a maximum of two occasions a year, and only where no courtesy vehicle is available. The driver must be aged 21 to 74 with an acceptable licence and meet the hire company’s terms. Not covered where the vehicle was unroadworthy, on the third or later claim in the year, where costs are recoverable elsewhere, or where a hire vehicle was obtained by misrepresentation.
- Conditions you have to meet
- The claim must keep reasonable prospects of success throughout; you must report within 180 days; and you must not incur costs before we accept the claim in writing.
- Where you’re covered
- Great Britain, Northern Ireland, the Channel Islands and the Isle of Man. For Uninsured Loss Recovery, cover extends to listed European countries.
This is a summary. Your policy wording (Lawshield Motor Elite / Motor Elite Extra) sets out the full list of exclusions and conditions — please read it.
